These Terms of Service (“Terms”) govern your use of the services provided by Ay Marketer (“we,” “our,” or “us”) and your interactions with our website, aymarketer.com. By engaging with our services, you agree to these Terms. If you do not agree, you must not use our services.
Ay Marketer offers digital marketing services, including but not limited to marketing strategy and consulting, paid advertising and campaign management, funnel building and automation, and website optimization and related services. All services are provided on a monthly subscription basis and require upfront payment before work begins.
To work with Ay Marketer, you must be an individual or business that agrees to our monthly subscription terms and have a registered business. We reserve the right to refuse service to anyone who does not meet these requirements or for any other reason at our sole discretion.
Payment is collected on a monthly basis. The agreed-upon amount must be paid before services commence each month, on the specified billing date. Services for that billing cycle will only begin once payment has been received. Your payment secures the agreed number of service hours for the next 30 days. You may cancel your subscription at any time. Upon cancellation, any unused service hours will remain available for use until fully consumed. Payments are non-refundable, including for unused hours or partially completed billing cycles.
To ensure the best results, you agree to provide all materials, access, and information required to perform the services. Delays in providing requested materials may impact project timelines and service effectiveness. You also agree to respond promptly to communications to keep workflows and campaigns on track and to follow agreed-upon timelines and approvals for project execution. Failure to meet these responsibilities may result in delays, for which we are not responsible.
While we strive to deliver high-quality results, we do not guarantee specific outcomes (e.g., sales performance, ad results, or market response), as these depend on factors outside our control. We reserve the right to modify, update, or discontinue certain services at our discretion. If significant changes are made, we will notify affected clients in advance.
You agree not to use our services for any illegal, unethical, or misleading purposes, including but not limited to false advertising, promotion of prohibited products or services, or spamming or unauthorized use of website forms. Additionally, all materials, strategies, and recommendations provided as part of the service are intended for your use only and may not be resold, shared, or distributed without prior written consent.
We use third-party tools and platforms (e.g., Google Ads, Facebook Ads, Go High Level) to deliver our services. You are responsible for complying with the terms and conditions of these third-party tools. We are not liable for any issues arising from your use of these tools.
Any marketing materials, strategies, or deliverables created by Ay Marketer remain our intellectual property until full payment has been received. Once paid, you have the right to use the deliverables for their intended purpose but may not resell, claim authorship, or redistribute them without explicit permission.
We will treat all sensitive information shared by you (e.g., business strategies, financial data) as confidential and will not disclose it to third parties without your consent, except as required by law.
Ay Marketer is not liable for any business losses, revenue decreases, or other damages resulting from the use of our services. We make no warranties, express or implied, regarding the performance of any campaigns, strategies, or marketing efforts. You assume full responsibility for compliance with all applicable laws and regulations related to your business and marketing activities.
